STF ends compulsory retirement as the biggest punishment for judges

With the decision, the minister must be sanctioned with loss of position and salary

The Federal Supreme Court (STF) decided, this Tuesday (26), unanimously, to end compulsory paid retirement with maximum penalty imposed on judges. The decision maintains the determination of Minister Flávio Dino, who had said that serious infractions committed by magistrates should result in the loss of their position.

On March 16, Dino determined that serious infractions committed by magistrates should result in loss of position and, consequently, loss of salary, as the greatest punishment for disciplinary violations. Until then, judges had compulsory retirement as the maximum punishment, with the guarantee of receiving a proportional salary.

With the new decision, compulsory retirement no longer exists.
