Court orders Gayer to pay R$20,000 to PT for fake news

The Court of Justice of the Federal District and Territories sentenced federal deputy Gustavo Gayer (PL-GO) to pay R$20,000 in moral damages to PT. The decision was published this Tuesday (June 23, 2026). The reason is the publication of a video on Gayer’s Instagram profile attributing responsibility to the PT for the attack against Jair Bolsonaro in 2018. The information is from O Globo.

The conviction involves a publication in which Gayer stated that the party ordered Adélio Bispo to stab Bolsonaro in Juiz de Fora (MG), during that year’s presidential campaign. The PT’s lawyers maintained that the accusation has no “any factual basis” and it’s already been “denied by official investigations”.

The judge responsible for the case understood that the statement “exceeded the limits of freedom of expression”. The judge also concluded that Gayer is not protected by parliamentary immunity for the purposes of this action.

The sentence maintained the removal of the video from digital platforms, a measure that had already been determined injunctively at the beginning of the process.

The judge assessed that the publication damaged the honor and image of the PT and that the reach of social networks worsened the damage caused.

The decision is still subject to appeal.
