Judge who went to Hang’s dinner will judge action against him – 12/18/2024 – Panel

Judge Haidée Denise Grin, who participated in a dinner promoted by the owner of Havan, has been rapporteur since the end of October of an appeal involving the businessman.

She and at least 10 other State Justice magistrates attended an event organized by Hang last Monday (16) in a historic property he owns in Brusque (SC).

The dinner information was revealed by the DCM website.

Haidée was drawn on October 25th to analyze the defense of professor Guilherme Howes Neto, resident of Santa Maria (RS), who was forced at the beginning of the year to pay R$20,000 to Hang as moral damages.

The conviction occurred due to posts on social networks considered defamatory and offensive by the businessman.

The decision in the State Court against Neto was made by judge Gilberto Gomes de Oliveira Junior, from the 1st Civil Court of Brusque (SC). He is the son of judge Gilberto Gomes de Oliveira, who was also present at the dinner.

Neto’s defense told the Panel that she was surprised by the information about the rapporteur’s participation in the dinner. “Faced with such a scenario, Professor Guilherme Howes Neto will study the appropriate measures, at the appropriate time”, stated lawyers Guilherme Pacheco Monteiro and Tiago Gornicki Schneider.

In a note, the Court of Justice of Santa Catarina said that “it does not comment on the participation of magistrates in events outside the institutional scope”.

“The principle of functional independence guarantees magistrates the autonomy and impartiality necessary to exercise their functions, in accordance with the Federal Constitution and current legislation”, adds the body.

The 11 magistrates, contacted by the column, preferred not to speak out.

Hang’s press office stated that the dinner was part of “a visit to the restoration of Casa Renaux, built 115 years ago, which was destroyed and is part of the history of the city of Brusque and the state of Santa Catarina.”

The Panel also asked whether the expenses for the magistrates’ trip to Brusque and any stays were paid by the businessman, but there was no answer.
