Lula spends 6 months without choosing ministers for Vacancy at STJ – 04/04/2025 – Power

The President (PT) has not defined for almost six months which will be the open of ministers of the (Superior Court of Justice), which feeds speculation and leaves offices of a court overwhelmed of proceedings under the responsibility of Interinian magistrates.

The second most important court in the country has 33 seats, and two of these available chairs were vacancies with the retirement of Laurita Vaz ministers in October 2023, and Argaete Magalhães in January last year.

One of the vacancies will be occupied by one member of and the other, by a member of a TRF (Federal Regional Court).

Following the retirement of the ministers, the STJ itself was responsible for elaborating two lists of three names and sending them to the President of the Republic, but, amid internal disputes, only did it last October.

One of the reasons pointed out by court members for the delay is related to a comb that analyzed the lives of candidates, including any police investigations who have already weighed on them.

Both lists were voted on October 15. For the vacancy for the judges, Carlos Pires Brandão and Daniele Maranhão, from TRF-1, based in Brasilia, and by Marisa Santos, from TRF-3, based in São Paulo, were chosen.

The second list, made up of members of the Public Prosecution Service, has the Attorney of Justice Sammy Barbosa, from the Acre Public Prosecutor, the Attorney Marluce Caldas, the Public Prosecution Service of Alagoas, and that of the Federal Prosecutor.

STJ ministers of various wings and members of the federal government are unanimous in pointing out that the list of judges displeased the President of the Republic because he hoped that the name of Rogério Favreto, TRF-4 (based in Porto Alegre), was in it.

During a duty in 2018, which was at the time stuck in Curitiba. The measure was overthrown by the then president of TRF-4.

Lula’s discomfort is considered one of the reasons that made him hold the names so far. One of those currently pointed out as favorites to be chosen is Carlos Brandão, Piauiense supported by the Minister of (Supreme Federal Court).

Despite being chosen by former president () to the Supreme, Kassio has a good dialogue at the STJ and approached the Lula administration.

A wing of ministers closest to Gilmar Mendes has defended the name of Daniele Maranhão.

In relation to the Public Prosecution Service, the favorite is Marluce Caldas, who is aunt of the mayor of Maceió, João Henrique Caldas (PL), JHC. Despite being from Bolsonaro’s party, the mayor has been trying to approach the base of the current president.

Sammy, who is sponsored by STJ Minister Mauro Campbell, has lost strength since October because, according to several court members, Lula has attributed to his godfather the articulation that overthrew Favreto from the list.

Lula is expected to choose both names in April. After the president’s choice, the nominees will still be sabbathed and approved by the Senate before taking office.

While there is no definition of Lula, the two vacancies are occupied by judges who are called to act provisionally.

Since last year, the STJ has made a number of emergency measures to lower the number of court processes in the year.

In 2024, the court received, for the first time, more than 500 thousand cases for.

To avoid the prescription of criminal proceedings, measures were taken such as the creation of a task force, the convening of more than 100 auxiliary judges-which they act under the collection of productivity-and even the reduction of lectures and courtesy visits.

Currently, the STJ is the national court that receives the most cases in the world, according to the president of the court ,.

“It is a record that we should not be proud, because well demonstrates how the demand in the Superior Court of Justice is incompatible with human capacity and even the use of technology,” he said, ending the Court’s work last December.

The number of 500,000 lawsuits is approximately double what the court had received in 2010.

A task force was also created in the office inherited by Minister Daniela Teixeira, who joined court at the end of 2023, in criminal cases-she left the criminal area and started acting in private law earlier this year.

They were displaced to act with her officials of a cabinet who was without a starting minister, as well as 10 summoned judges.

During the period, the minister had to institute internal rules to meet the targets set by the presidency, which were placed on warning at the door of her office.

“I will receive in audience only processes of my rapporteur on the agenda; proceedings with an injunction request not appreciated. Without courtesy visits; without lectures; focused on preventive arrests and processes with risk of prescription.”

In initiatives to reduce the amount of cases, Herman Benjamin also increased the number of virtual judgments, in which ministers deposit their votes in the court system, without the need for face -to -face discussion.
