TCU suspends Galeão re-bidding and unlocks renegotiation

Court approved measure that gives legal certainty to the agreement between government, Anac and concessionaire; new auction is expected for March 2026

This Wednesday (October 8, 2025), the Federal Audit Court accepted the suspension of the re-bidding process, in Rio de Janeiro, until March 31, 2026. Here is the ruling (PDF – 543 kB).

The request was made jointly by the (Ministry of Ports and Airports), the (National Civil Aviation Agency) and the concessionaire RIOgaleão, responsible for the current management of the airport.

The measure allows the government to move forward with the renegotiation of the concession contract and carry out the “market test” (or assisted sale), a step that should lead to a new auction of the terminal.

In practice, the TCU’s decision does not create a new agreement, but it guarantees legal security for what already was, in June.

The suspension of the deadline is important for the parties because it prevents the government and the concessionaire from having to carry out 2 processes (the old re-tender and the renegotiation) at the same time

Without this pause, the legal deadlines for re-bidding would continue to run, which could force the government to interrupt negotiations or even initiate a contract expiry process.

REPACTUATION

With the approval of the TCU, the government will be able to follow the schedule announced by the minister (Republicans).

The agreement, on September 25, 2025, establishes the withdrawal of Infraero from the company and the holding of a new Galeão auction in March 2026, with a minimum bid of R$932 million.

“Our expectation is that we will hold this large auction in March. 100% of the asset will be up for grabs, but with the preservation of the airport”stated Costa Filho during the ceremony.

The TCU also determined that the technical units SecexConsenso and AudRodoviaAviação monitor the progress of the renegotiation and “adopt the relevant measures if any occurrence is identified that does not comply with what was approved by the Court”.
