Minister of the STF dismissed the defenses of the former advisor to the Presidency and Marcelo Câmara, defendants in Core 2 of the coup plot, alleging a maneuver to delay the process
The former international advisor to the Presidency of the Republic, defendant in the investigation investigating the attempted coup d’état, sent this Friday (10) a handwritten petition to the minister of the Federal Supreme Court (), asking for reconsideration of the decision that dismissed his lawyers and appointed the (DPU) to represent him. Martins stated that he did not authorize the replacement and classified the measure as “abusive” and contrary to the right to defense.
“I did not authorize, I did not request and I do not consent to the DPU or any legal defender representing me. I maintain full trust in the lawyers Ricardo Scheiffer Fernandes and Jeffrey Chiquini da Costa, who I have legally and regularly included in the files”, wrote the former advisor. In the decision published on Thursday (9), Moraes dismissed the defenses of Martins and Jair Bolsonaro’s former advisor, under the justification that the lawyers failed to present the final arguments within the deadline and had adopted a “procrastinatory maneuver” to delay the process. The minister accused the defenses of litigation in bad faith and ordered the DPU to assume representation of both.
Martins’ lawyers contested the judge’s version and claim that there was no deadline missed. According to them, a request was filed to reopen the deadline to contest documents included by the (PGR) at the end of the investigation phase, which, according to the defense, would not have chain of custody nor were they subjected to expert examination.
In the petition, Filipe Martins requests that Moraes reestablish the legitimacy of his lawyers and reject the actions of the Public Defender’s Office. If the request is denied, it requests a new minimum period of 24 hours for its defenders to present their final arguments. Lawyer Jeffrey Chiquini stated, in a statement, that the minister’s decision represents “a serious violation of the right to defense and the Democratic Rule of Law”. He said that the defense will appeal to the Brazilian Bar Association (OAB), the Inter-American Commission on Human Rights and other entities.
Filipe Martins is accused of being part of “nucleus 2” of the alleged coup plot, appointed by the PGR as responsible for managing the group’s actions. The process is in the final stage, and the trial should be scheduled in the coming weeks by the STF.
