The deputy’s report text (Avante-MG) establishes a system that allows real-time monitoring of the attacker’s location. The objective is to prevent new attacks and reinforce compliance with legal measures.

The project determines that electronic monitoring is applied in case of risk to the physical or psychological integrity of the victim or non-compliance with protective measures. The precautionary measure must be requested by the police authority in situations of risk of aggression, in accordance with the National Risk Assessment Protocol.

The device must also issue an automatic and simultaneous alert to the victim and the nearest police unit when the attacker fails to comply with the minimum distance determined by the Court.

The proposal also establishes an increase in the penalty from 1/3 to half when non-compliance occurs due to violation of electronically monitored exclusion areas or the removal, violation or alteration of the monitoring device without judicial authorization.

The text changes to include electronic monitoring as an urgent protective measure in cases of domestic violence.
