Government wants to speed up evictions

The idea is to give greater autonomy in the definition of contracts and greater speed in the courts in case of non-compliance.

António Leitão Amaro presented the new proposals do Government about the crisis in housing.

There is four pillars: greater contractual freedom between landlords and tenants, reinforcement of confidence in the fulfillment of contracts, greater speed in justice in the event of non-compliance and clarification that social responses must be assumed above all by the State.

“The solidarity function must be performed by the State” – with an emergency housing fund, declared the minister.

The idea is to speed up the resolution of land and property sharing when there is no agreement between the heirs: the succession arbitration route is followed, without going to court.

The Government essentially wants to reinforce confidence in the rental market, explained the Minister of the Presidency, in the briefing of the Council of Ministers.

According to the Executive’s accounts, there is almost 400 thousand houses that could be inhabited – and are not. Of these, 250,000 are “in good condition but are neither for sale nor for lease”, announced Leitão Amaro.

For the Government, rental contracts must be based on a logic of compliance between the parties; Situations of greater economic or social fragility must be addressed through public support instruments.

The Government thus wants to encourage owners to place more properties on the rental market.
