Measure, which begins to be processed in the Federal Senate, would also apply to vehicles registered in company names
In the coming days, the Senate will begin analyzing a bill already approved in the Chamber of Deputies that guarantees the buyer of a used vehicle the right not to pay fines from the previous owner after the vehicle is transferred.
The text of PL 3,509/2024 amends the Brazilian Traffic Code to make it clear that, in the case of transfer of ownership of a used vehicle, infractions committed by the former owner and entered late into the National Traffic Infractions Registry will not be attributed to the new owner of the vehicle.
The measure also applies to vehicles registered in company names.
In cases of leasing or financing with vehicle security (fiduciary lien), the fines must be charged to the person who actually used the car at the time of the infraction.
