Corporation decreed temporary arrest of Marcos Antonio da Silva Neto after he failed to attend the hearing scheduled for Monday (6); crime occurred in Frutal, in the Triângulo Mineiro
The Civil Police of Minas Gerais (PCMG) considers as fugitive the young Marcos Antonio da Silva Neto, 19 years old, suspected of having in the Novo Horizonte neighborhood, in Frutal, in the Triângulo Mineiro. The temporary arrest of the person being investigated was ordered after he breach a spontaneous presentation agreement e miss the deposition scheduled for Monday (6).
In a note released this Wednesday (8), the corporation reinforced that, regardless of the motivation, “justice with one’s own hands” is not permitted by Brazilian law and that the use of force is the exclusive responsibility of the State.
The crime took place in March 31st and it happened due to a act of revenge against Rafael Garcia Pedroso, 31 years old. According to investigations, Marcos confessed to the crime to his own defense, claiming response to mother’s deathmurdered approximately ten years. At the time, he only had 8 years and said to have witnessed the crime. “I saw every stab wound, my mother fell bloody and the last things she said to me was, ‘son, give me a hug’”, explained the young man in a statement to lawyers.
Rafael Garcia Pedroso had been convicted of popular jury in 2019 for the murder of Marcos’ mother, but the decision was annulled due to procedural error. He fulfilled house arrest since January this year, while awaiting a new trial.
Wanted by Young Pan on Tuesday (7), Marcos’ defense, made up of lawyers José Rodrigo de Almeida and Isabella Kathrine Vieira do Carmo, reported that the young man tried to hand himself over to the police from the first day after the crime. They claimed that the plan was delayed because the lawyer responsible was in Innocência (MS) and was only able to reach Frutal after the police station closed. Therefore, they chose introduce the boy directly to the chief delegate the next day. The lawyers also stated that they collaborated with the authorities to make the spontaneous presentation possible.
However, the Civil Police scheduled Marcos’ hearing for April 6th. He didn’t attend. In light of this, the temporary prison and the young man was considered a fugitive. The investigations are at an advanced stage and PCMG is investigating the possible involvement of other people in the events.
In addition to Marcos, three other men are being investigated for the murder: another 19 year old, a 25 year old e a 35 year old. The latter was arrested on the 1st for serving a conviction warrant for another crime.
