The Court of Justice accepted an appeal and unanimously decided to condemn federal deputy Gustavo Gayer (PL-GO) on Wednesday (8) for insults against the former minister of Institutional Relations () and the deputy leader of the government in the Chamber, (PT-RJ).
In March 2025, Gayer stated in a publication on [garota de programa]”. The congressman also insinuated that the then minister and her partner would have a threesome with Alcolumbre.
The post, which was later deleted, was made after Lula stated that the government wanted to “improve the relationship” with .
A Sheet tried to contact Gustavo Gayer’s press office by message and call to obtain the deputy’s position regarding the conviction. There was no response until the publication of this report.
After an appeal, the 6th Civil Panel of the TJDFT (Court of Justice of the Federal District and Territories) reversed the sentence of the 17th Civil Court of , which had understood that the PL deputy’s comments were made in the exercise of his parliamentary mandate and did not constitute a crime.
The court decided that the PL congressman must pay compensation for moral damages of R$10,000 to Gleisi and Lindbergh, in addition to publishing a public retraction on all social networks, with express mention of the court decision, within ten days and under penalty of a daily fine of R$1,000.
In his vote, judge Alfeu Machado stated that comparing Gleisi Hoffmann to a call girl would be misogyny and a form of institutional violence for “reducing a State minister to a sexual stereotype”.
“The language used is foul, sexualized and devoid of any political or institutional content. In the demonstrations, there is no mention of the President of the Republic’s speech that would have originated the criticism, nor is there any contextualization that allows the posts to be understood as part of a legitimate public debate,” he declared.
Regarding the comment about a “trisal”, the case’s rapporteur said that Gustavo Gayer’s statement would be a “direct attack on the perpetrators’ intimate life, with sexualized and humiliating content, disseminated on a far-reaching social network, with millions of followers”.
“The dissemination of the posts in the digital environment expands and enhances the scope of the damage and worsens its repercussion. The author, as a Minister of State, was reduced to sexual stereotypes, in flagrant disrespect for her public role and her condition as a woman. The author, in turn, was exposed in her marital intimacy, without any institutional justification. The moral damage, therefore, is characterized not only by the content of the posts, but by the way they were disseminated and the context in which they were published.”
The judge also declared that parliamentary immunity cannot be used as a “shield”. “The defendant questions the author about his marital relationship, insinuates submission and humiliation, and associates him with sexual practices in a mocking tone. This is content that has no relevance to the exercise of parliamentary functions, and which reveals an intention to reach the authors’ private sphere”, he said.
He was accompanied by judges Arquibaldo Carneiro and Vera Andrighi.
In a video published on social media, Gleisi and Lindbergh celebrate the decision of the Federal District Court and pushed for the approval of the project that includes misogyny among prejudice crimes. The text, however, faces resistance from the opposition and, therefore, has not yet passed through the Chamber.
“Misogyny has to be a crime,” said the former minister. “This conviction of Gustavo Gayer has a very great didactic importance. They are moving to prevent the vote on the misogyny PL. We have to make a big move”, added the deputy.
