An article by , proposing broad reform of the Judiciary, gained attention at a time when the image of the Federal Supreme Court is clearly deteriorating. almost always astute and shrewd in his political movements, he was seen as a response to the agenda of public opinion and Edson Fachin, who demands measures of transparency, restraint and coherence in the court’s actions.
Dino would be pointing to the great solution, leaving aside the small debate.
The idea of a new reform of the Judiciary, which addresses its major problems, is welcome. But it should not be used as a smokescreen to obscure issues that can and need to be addressed and resolved without the need for such a complex process.
In other words, it doesn’t make sense for the proposal to serve as a smokescreen to shield deviations that call for a solution, on the basis of “ah, it’s not just us, the entire Power is problematic”.
What is observed is that , with emphasis on some of its greatest exponents, such as , and , struggling with a delusional disorder. There is a fixed and unshakable belief that criticism of the court’s collective and individual behavior is nothing more than attacks orchestrated by the extreme right with the aim of overthrowing the law and democracy in the country.
That characters with these purposes exist serves to justify the denial of magistrates in defense of their privileges and erratic and abusive decisions.
It is surprising, in this sense, because it presents itself as the minister’s umpteenth pedestrian political initiative and involves the former governor of Minas Gerais in the infamous fake news investigation, which has been going on for seven years. The reason is the release of a caricatural video animation, made with puppets, in which a Dias Toffoli doll asks the Gilmar doll to suspend the breach of its confidentiality determined by the Organized Crime CPI.
This is intimidation and an attempt to restrict freedom of expression to which even disqualified politicians such as the former governor have the right guaranteed by the Constitution.
It is depressing that the organizer of the controversial, perhaps even promiscuous, Lisbon Forum, has resorted to the aberration that fake news research has become. It is deplorable that we still have to live with this legal frankenstein instrumentalized in a fascist way to coerce anyone who dares to harm the private and corporate interests of magistrates.
The crucial role of the court and particularly of Moraes in defending democracy against the Bolsonarist coup is not discussed. It turns out that it is not acceptable to shield the STF from criticism and suspicion under the eternal argument that coup plotters can return and court ministers can be questioned by the Senate.
That the usual sycophants do so is natural. President Lula himself, however, with the emergence of the Master case, already smelled burning and warned
Lula also defended the stipulation of mandates for STF ministers – an aspect that, who knows, could one day be part of the reform proposed by Dino, which today is just foam on a website. And it may never be much more than that.
