In a decision given this Thursday (23), judge Roberto Lemos dos Santos Filhofrom the 5th Federal Court of Santos, ordered the preventive detention of 36 people under investigation by the Federal Police during Operation Narco Fluxo. Among the targets whose custody was ordered are the singers MC Ryan SP and MC Poze do Rodoin addition to Raphael Sousa Oliveira, owner of the entertainment page Choquei.
The judge stated that the new arrest order is based on the need to guarantee public order and ensure criminal prosecution in the face of new elements presented by investigations. “The defense became aware, very recently, of the Federal Police’s representation for the decree of preventive detention, formulated only after the granting of habeas corpus by the STJ, which recognized the illegality of the extension of the temporary detention.
The manifestly extemporaneous nature of the request is perplexing. If the preventive requirements had been present before, why was it not requested at the appropriate time?
The defense hopes that the measure will be rejected and the decision of the Superior Court of Justice will be effectively complied with.”
Defense by Raphael Sousa Oliveira
‘The defense of Raphael Sousa Oliveira, owner of the Choquei page, informs that he will immediately appeal to the Federal Regional Court of the 3rd Region, the Superior Court of Justice and, if necessary, the Federal Supreme Court, to reestablish the Constitution.
Criminal lawyer Pedro Paulo de Medeiros states that the new decision repeats defects already pointed out by the defense since the temporary arrest was decreed, especially due to the lack of individualized reasons in relation to Raphael Sousa Oliveira, as the judge does not even mention his name in the decision. According to the defense, the decision does not present concrete and specific elements that justify the imposition of the extreme measure in relation to the person being investigated.
Pedro Paulo de Medeiros maintains that the decree of preventive detention maintains the same lack of concrete grounds already questioned by the defense and violates the constitutional and legal requirement to motivate decisions that restrict freedom, especially due to the lack of individualization of the reasons attributed to Raphael Sousa Oliveira.
The defense also argues that the decision does not specifically demonstrate why preventive detention would be necessary in the specific case, nor does it present individual grounds that authorize precautionary custody. Therefore, it will immediately question the decision in higher courts.”
