President of the Senate withdrew points from the vote that, if approved, would annul harsher penalties that were recently created against organized crime, militias and feminicide
The president of the Senate, Davi Alcolumbre, announced this Thursday (30) a maneuver that removed excerpts from the Dosimetry PL of the Congress voting agenda. The decision, communicated in plenary, aims to avoid that the possible overturn of the veto ends contradicting the Anti-Faction Law. The information had been anticipated by Jovem Pan News.
The Dosimetry PL, which alters rules in the Penal Code for setting penalties for crimes against democratic institutions and changes regime progression rules, was approved in December 2025. However, the text was vetoed in its entirety by President Lula (PT) in January. A month later, Congress approved the Anti-Faction Law, which also brought new rules for sentence progression.
According to Alcolumbre, a detailed analysis showed that the two projects conflicted. If the veto on the Dosimetry PL was completely overturned by Congress, some of its provisions would annul the most severe punishments established by the Anti-Faction Law.
The contradiction occurred specifically in items 4 to 10 of article 112 of the Criminal Execution Law, which deal with the regimen progression for convicted of private militia formation, feminicide, heinous crimes and for leaders of criminal factions.
“This scenario would represent an invalidation of the recent expression of will of this National Congress on this matter, as well as it would mean a step back in actions to combat crime, especially feminicide and organized crime”, explained Alcolumbre.
To avoid contradiction, the president of the Senate used the Internal Regulations of the Senate to declare the “harmfulness” (i.e., the loss of validity for voting) of the conflicting sections. He justified the maneuver for two main reasons: temporalitysince the Anti-Faction Law was voted later, and the purposeas the original intention of the Dosimetry PL was not to relax the rigor against these specific crimes.
As this is a total veto by the president, the deliberation will take place in a single vote recorded on the electronic panel. If parliamentarians decide to reject the veto, the Dosimetry PL will be enacted and will become law in almost its entirety. The only exceptions will be the provisions removed from the vote by Alcolumbre (items 4 to 10).
