Dayany Bittencourt got a seat in the Chamber due to the electoral quotient of votes received by União Brasil
The federal deputy (União Brasil-CE) will lose her seat in the Chamber after the Superior Electoral Court confirmed the revocation of the diploma of (União Brasil-CE), elected as a substitute federal deputy in 2022. The woman from (União Brasil-CE), pre-candidate for the Senate, said she is a victim of “political gender violence”.
It was unanimous. The court ordered the annulment of Freire’s votes, the retotalization of the vote and the recount of the electoral and party quotients in Ceará. As a result, Dayany’s successor will be defined after the recount of the votes.
Dayany had won the mandate due to União Brasil’s performance in calculating the electoral quotient. With the removal of Freire’s votes from the party’s account, the party loses strength in the distribution of federal deputy seats throughout the State.
Freire had his diploma revoked due to illicit collection and expenditure with resources from the (Special Campaign Financing Fund), known as the Electoral Fund. The irregularities totaled R$ 1,668,671.42, equivalent to 60.48% of the funds raised by the candidate and 48.95% of the contracted campaign expenses.
The case’s rapporteur, Minister Antonio Carlos Ferreira, said that equality of chances between candidates is affected when public money is no longer monitored by the Electoral Court.
“Equality of chances between candidates is not compromised only when it is proven that the money went to the wrong place, but it is compromised every time public money disappears from electoral inspection without leaving a trace”he stated.
According to Ferreira, the revocation of the diploma or mandate due to illegal electoral practices results in the nullity of the votes attributed to the candidate and the automatic recount of the electoral and party quotients.
In a video published on Instagram, the deputy was the target of persecution and declared that the decision seeks to harm her husband, who alongside (PSB).
“They took away my mandate. It seems like a lie, but unfortunately it’s true. After 3 and a half years since the election, the Electoral Court decided to carry out a recount of the votes that will remove me from my seat as deputy. This is gender-based political violence”these.
Dayany stated that he had not committed any irregularities. “It hurts because I wasn’t accused of anything. It hurts because I didn’t make any mistakes, I’m not ineligible. It hurts because I had a clean, productive mandate, dedicated to Ceará”he declared.
(PSDB-CE), to the Government of Ceará, expressed solidarity with the deputy. He on Instagram makes it strange to see opponents of the senator (PT-CE) and the governor (PT-CE) being persecuted.
