The Second Panel of the Federal Supreme Court (STF) decided, this Tuesday (16), maintain the preventive arrests of businessman Felipe Cançado Vorcaro and Henrique Moura Vorcarorespectively cousin and father of banker Daniel Vorcaro. The trial was resumed after minister Gilmar Mendes returned the cases for analysis by the collegiate.
The magistrates endorsed the previous decisions of the rapporteur, Minister André Mendonça, which had already received advance support from Minister Luiz Fux. With the return of Gilmar Mendes’ request for a review, the Court confirmed the need to maintain precautionary custody of those investigated, arrested within the scope of Operation Compliance Zero.
The investigation by the Federal Police (PF) finds Non-Bank Master fraudsliquidated by the Central Bank at the end of last year. Felipe Vorcaro, arrested on May 7, is named by investigators as centerpiece of the group’s financial-operational core. Henrique Vorcaro was arrested on May 14, on suspicion of integrate the so-called “violent nucleus” of the organization and act as a financial operator.
In his vote on May 23, Minister André Mendonça argued that there is aimed at the committing crimes with serious social repercussions. According to the rapporteur, preventive detention is necessary to ensure public order e ensure the application of criminal lawsince alternative precautionary measures would be insufficient given the seriousness of the facts.
Mendonça also highlighted, based on an opinion from the Federal Public Ministry (MPF), that Felipe Vorcaro exercised a significant role in illicit transactionsespecially in money laundering schemes.
The Second Panel of the STF is made up of ministers André Mendonça, Luiz Fux, Gilmar Mendes, Nunes Marques and Dias Toffoli. However, Minister Dias Toffoli declared himself a suspect in judging cases related to Banco Master and its developments, after having reported the investigation until February this year.
