CPMI FINDINGS

CPMI investigates fraud in loans granted to INSS retirees and pensioners. The collegiate closes its activities on March 28th.

With the beginning of the investigations, congressmen focused on the relations of businessman Antônio Carlos Camilo Antunes, the INSS’s Careca, with associations that carried out irregular association discounts and with members of the Social Security leadership.

One of the commission’s targets is Fábio Luís Lula da Silva, known as Lulinha, who had requests to break tax secrecy. Opposition congressmen tried to look for evidence of Lulinha’s relationship with Careca from the INSS.

According to the president of CPMI, Carlos Viana, Minister Flávio Dino’s decision, which suspended Lulinha’s breach of confidentiality, prevented the data from being analyzed in time by congressmen.

Dino stated that, although Parliamentary Commissions of Inquiry and CPMIs have the power to determine the breach of confidentiality, when exercising this attribution, they assume a role similar to that of a judge. Therefore, they must observe the same duties as a magistrate, which requires technical justification for each person investigated and voting on a case-by-case basis.

BREAK OF CONFIDENTIALITY

The commission a folder of 1,08 GB with information from the investigation carried out on the cell phones of the founder of Banco Master, Daniel Vorcaro. THE Poder360 had access to the material. Of the total, 221 files of the banker —which ended up being leaked— amount to 329,3 MB. The data includes images, emails, contacts and documents stored on the devices.

The collection analyzed by the Poder360 shows that the extraction of Vorcaro’s cell phone goes beyond isolated messages. The content includes diary records, emails, business files and images that help to reconstruct the banker’s network of relationships. LEAKS INQUIRY

Mendonça ordered, on March 6, the opening of an investigation to investigate the leak of information from Vorcaro’s cell phone.

In the decision, the minister highlighted that sharing the breach of confidentiality does not authorize the leaking of information by members of the CPI. “Quite the contrary, it entails, on the part of the authority that received the restricted access information, responsibility for maintaining secrecy. This is because, clearly, any breach of confidentiality does not make the information accessed public.“, declared the minister. Read the (PDF – 179 KB).
