Who and when can take time off for a holiday falling on Saturday?
Pursuant to Art. 130 § 1 of the Labor Code, public holidays that fall on a day other than Sunday are included in the settlement period. This means that if a holiday falls on a Saturday, which for most employees is a day off from work due to an average five-day working week, the employer is obliged to grant the employee another day off in the same settlement period.
A day off for a holiday on Saturday is not an “additional” day off from work. This is a day that compensates for the reduction in working hours in a given settlement period. The employer must ensure that the employee’s working time standard in a given settlement period is maintained. Employees employed under an employment contract who work in a system where Saturday is a day off due to an average five-day working week are entitled to a day off on Saturday. Employees who work on Saturday according to the schedule (e.g. shift work or weekend work) will not always be entitled to an additional day off in this respect, because for them Saturday is not a day off due to the average five-day working week. In their case, the holiday on Saturday is treated like any other holiday.
