Moraes orders RJ to preserve evidence of the mega-operation and give access to the public defender’s office

The measure responds to a request from the Federal Public Defender’s Office (DPU), and was issued in the files of ADPF 635, which deals with the actions of public security forces in communities in the State.

The minister of Federal Supreme Court (STF), Alexandre de Moraesdetermined, this Sunday (2), the “prevention and rigorous and complete documentation” of evidence of the mega-operation in the Rio de Janeirowhich occurred on Tuesday, October 28, in the Alemã and Penha complex, and left 121 people dead. The measure responds to a request from the Federal Public Defender’s Office (DPU), which asked the STF that all elements be preserved, and was issued in the files of ADPF (Arguição de Descumprimento de Preceito Fundamental) 635 – also known as ADPF das Favelas -, which deals with the actions of public security forces in communities in the State.

The mega-operation in RJ against the Red Command (CV), the most lethal in the state’s history, left 121 dead, 117 criminals and 4 police officers, and also saw the arrest of 113 people, 40% of whom were not from Rio de Janeiro, according to investigations. According to the RJ Civil Police Secretary, the suspects include citizens from 8 other regions of Brazil, namely: Pará, Amazonas, Bahia, Ceará, Paraíba, Goiás, Mato Grosso and Espírito Santo.

In the order signed by the minister, the governor of Rio de Janeiro, Cláudio Castro, must be summoned. In the determination, Moraes also requested a joint hearing for next Wednesday (5/11), at 10 am, in the room of the First Panel of the STF. The following bodies must be present at the meeting requested by Moraes:

  • Citizenship of the Legislative Assembly of the State of Rio de Janeiro;
  • Angels of Liberty Institute;
  • Human Rights Network Association – Conectas Human Rights;

  • Education and Citizenship of Needy Afro-descendants – Educafro; Global Justice;
  • Institute of Religious Studies – ISER;
  • Network of Communities and Movements against Violence;
  • Fala Akari Collective;
  • Coletivo Papo Reto;
  • Right to Memory and Racial Justice Initiative;
  • Unified Black Movement – ​​MNU;
  • Center for Justice and International Law – CEJIL;
  • UFRJ Human Rights Laboratory – LADIH;
  • Luiza Mahin Popular University Legal Advisory Center – NAJUP;
  • Institute for the Defense of the Black Population – IDPN;
  • Mothers of Manguinhos Movement and Institute of Racial and Environmental Advocacy – IARA.

On Monday (2), Moraes has an audience with Cláudio Castro, where the governor must provide information about the mega-operation. I continue, the minister has already informed that the DPU should not participate in the hearing. In RJ, he will also speak to other state authorities to gather information about the operation. The meeting with Castro will take place at 11am, and with the city mayor, Eduardo Paes (PSD), at 6pm.

The meetings were scheduled within the scope of Moraes’ determination, last Wednesday, 29, so that Cláudio Castro could provide information on compliance with the guidelines adopted by the Court in the police operation
