OECD: Brazil complies with only 4 of 35 anti-bribery actions – 04/01/2026 – Panel

A report published this Tuesday (31) by the (Organization for Economic Cooperation and Development, an entity known as ) says that Brazil has not implemented or only partially implemented most of the recommendations made in 2023 in the body’s convention against transnational bribery.

There were 35 suggestions made by an OECD anti-bribery working group, of which only 4 were implemented. Of this total, 16 were not applied and another 15 were only partially applied.

The report highlights concerns from OECD member countries with the decision of the minister, of the (Supreme Federal Court), of September 2023, which dealt with all the evidence of the Odebrecht leniency agreement.

“The STF’s monocratic decision of September 2023 identified possible procedural irregularities related to the way Brazilian authorities obtained evidence through international cooperation with another party to the convention in the Lava Jato investigation involving Odebrecht,” says the report.

“As a result, several members of the Working Group expressed concerns that, conversely, Brazilian authorities may be unable to cooperate with their investigations into related illicit conduct.”

The document also shows concern about other Supreme Court decisions.

One of them is about the renegotiation, validated by André Mendonça, of leniency agreements for construction companies involved in international scandals. The report also cites the investigation by the minister.

In a note, the NGO Transparency International, which monitors and subsidizes the work of the OECD group, said that the convention has a specific focus on a type of “committed by rich countries (where the headquarters of the largest international companies and exporters are located) and has less developed countries as victims (where these companies have historically corrupted local governments in search of advantages)”.
