Project allocates resources raised from collectors, shooters and hunters to Funapol to pay for inspection
The Public Security Committee of the Chamber of Deputies approved the , by deputy Delegate Fabio Costa (PP-AL), which transfers the responsibility for inspection and collection for the registration and concession of gun ownership for collectors, shooters and hunters (CACs) to the Federal Police (PF). Currently, according to the Disarmament Statute (Law 10,826/03), this responsibility lies with the Army.
Furthermore, the Federal Police will be responsible for registering and granting possession for foreign athletes in shooting competitions in Brazil. The carry authorization for the security of foreigners visiting or based in Brazil will also be transferred to the PF. Currently, this responsibility is the responsibility of the Ministry of Justice.
The text maintains the authorization and supervision of production, export, import, customs clearance and trade in firearms and other controlled products with the Army.
According to the proposal, resources from the collection of fees and fines will be credited directly to the Army Fund when collected by the Army, or to the Fund for Apparatus and Operationality of the Federal Police’s End Activities (Funapol) when collected by the Federal Police. The amounts will be used exclusively for funding and investment in inspection activities for controlled products under the responsibility of each institution.
In addition to the Disarmament Statute, the project amends Law 10,834/03, which deals with the Controlled Products Inspection Fee (TFPC); and Decree 24,602/34, which provides for inspection of factories and trade in weapons, ammunition and explosives, to adjust the change in competences.
Fee table
The project presents a table with the values of fees and fines for the inspection of controlled products. Among the amounts provided for are a registration fee (grant: R$2,000; revalidation: R$1,000) and fines ranging from R$500 (minimum simple fine) to R$2,500 (pre-interdiction fine).
The table specifies which fees are the responsibility of the Army Command, which are the Federal Police and which can be charged by both institutions depending on their competence over the product or activity.
The author of the project recalls that the oversight and control duties of the CACs were transferred from the Army to the Federal Police as of July 2025, under the terms of Decree 11,615/23. However, CAC rates did not follow this redirection. “The measure preserves the administrative logic according to which resources must accompany competence. Whoever carries out the assignment must have the corresponding financial means to carry out their functions“, argued Fabio Costa.
For the rapporteur, deputy Marcos Pollon (PL-MS), the project corrects the distortion in the allocation of resources. “This measure contributes to the institutional strengthening of the Federal Police, ensuring greater operational capacity to carry out the duties conferred on it by the legal system.“, these.
Pollon stated that the appropriate allocation of these resources will enable investments in technology, infrastructure, training and improvement of inspection activities, fundamental elements for greater efficiency in controlling controlled products and combating illicit activities related to the misuse of firearms.
Next steps
The proposal will still be analyzed, in conclusive characterby the Foreign Relations and National Defense committees; Finance and Taxation; and Constitution and Justice and Citizenship. To become law, it must be approved by the Chamber and Senate.
