The São Paulo Court rejected the request for compensation of R$60,000 for moral damages, filed by the former councilor (PL-SP) against the former state deputy and youtuber . The action was motivated by statements made by Arthur during a live broadcast on YouTube.
On the occasion, Arthur do Val mocked the political reconciliation between Holiday and the former president (PL).
According to the sentence of the São Paulo Court, the former deputy satirized the situation saying that Holiday “he did the most humiliating thing ever: he knelt down for Bolsonaro”, and completed: “I’m sorry, I’m sorry, I’m sorry, Bolsonaro. I’m your black, faggot son, who left and came back home and you took me in.”
The Special Civil Court considered that the statements, although “harsh and inelegant“, are supported by freedom of expression within the context of political debate.
“SATIRIC PARAPHRASE”
Judge Luciano Persiano highlighted in his decision that Fernando Holiday himself had already used a similar expression in 2023, when commenting on his affiliation with the PL, when he said that Bolsonaro was joining “a half-deer black man”.
For the magistrate, Arthur do Val’s speech was a “satirical paraphrase” with the intention of “scratch the political turn” of the former councilor, without direct intention of racial or homophobic offense. The sentence reinforces that, as they are public figures, both are more exposed to criticism and rude expressions in disputes over ideas.
CASSATION OF ARTHUR DO VAL
Arthur do Val, who was part of the União Brasil party, had his term as state deputy for Alesp (São Paulo Legislative Assembly) and lost his political rights for 8 years.
The punishment occurred after the leak of audios about Ukrainian refugees. In the recordings, made during a trip to the border under the justification of humanitarian aid in the war, Arthur stated that the women in the refugee line were “easy, because they are poor“, in addition to making other sexist statements.
