The president of the (Federal Supreme Court) expressed solidarity with the ministers who were “unduly mentioned” in the final report of the (Parliamentary Commission of Inquiry) on Organized Crime and spoke of a “deviation from the purpose” of the parliamentary body.
In a note released on Tuesday night (14), Fachin said that he “emphatically repudiates” the inclusion of the names of , and in the report, which ended up rejected by the commission.
Throughout the morning, the minister sought out his colleagues to say that the CPI’s initiative was “very serious” and to make himself available for dialogue. He said he was monitoring the issue with “high concern” and that the scenario demanded firmness and serenity.
Fachin released a note in which he said that the CPIs are a legitimate instrument of supervision and control, but that they must act in a manner “circumscribed to the thematic relevance that gave rise to their creation”, within constitutional limits.
“Deviations from the thematic purpose of these commissions weaken the democratic pillars and threaten the fundamental rights of any citizen,” he said.
He also wrote: “No one is above the law, and the fundamental rights prescribed in the Constitution must be fully observed. The independence of the Legislative Branch must be preserved in the investigation of facts, always with responsibility and relevance.”
According to the minister, the court “is aware that it is up to everyone to respect the independence and autonomy of the Powers”.
“The Federal Supreme Court reaffirms that it will remain steadfast in its mission of guarding the Constitution and protecting democratic freedoms. The Presidency therefore stands in solidarity with fellow ministers mentioned in the report of the Parliamentary Commission of Inquiry into Organized Crime.”
