The minister of the (Supreme Federal Court) suspended the elimination of a candidate for a competition from Tocantins, who had been barred because her height is lower than the minimum required.
The notice stipulated a height of at least 1.60m for women to seek a place in the corporation, but candidate Jordana Alves Jardim measures 1.55m. The minister understood, however, that this limitation did not comply with jurisprudence already established by the Supreme Court.
The STF established that the adoption of physical capacity requirements for access to public positions must comply with suitable and proportional selection criteria.
In precedent, the court considered the minimum height requirement for public security careers to be reasonable, as long as it follows the parameters set for the Army: 1.60m for men and 1.55m for women.
In Zanin’s assessment, therefore, the notice failed to comply with this determination. He also stated that the candidate’s prior approval in physical tests demonstrates that she is capable of performing the role.
The STF’s understanding is that, if a candidate passes the Physical Fitness Test (TAF), there is proof that the height is compatible with the functional performance of the position.
