Suspect of stealing R$813 million is released in Spain after Lula government fails to meet deadline

Brazilian government missed international treaty deadline for sending extradition documents; group is accused of the biggest hacker attack on the country’s financial system

Pointed out as gang leader responsible for biggest hacker attack already registered against Brazil’s financial system, Ítalo Jordi dos Santos Pireneus, known as “Breu”, and six other members of his group are in provisional freedom in Spain. The complaint indicates that the amount embezzled is approximately R$813 million. The information was published by the website O Bastidor and confirmed by Young Pan.

The release, which took place on January 16, was caused by a delay by the Brazilian Ministry of Justice, which failed to meet the deadline set by an international treaty to send the extradition request documentation.

The bilateral agreement between Brazil and Spain, in force since 1988, establishes a 80 day limit for the formalizing the request after arrest. Considering that the warrants issued by the São Paulo Court of Justice were dated October 17th of last year, the deadline was January 5th, 2026.

However, the Brazilian government documents reached the Spanish Court January 19th only14 days late, forcing the provisional release of the accused.

The group had been arrested on October 30 in Madrid, during the second phase of the Federal Police’s Operation Magnas Fraus. They are accused of convert R$600 million from the theft into cryptocurrencies.

The processing of the case was also hampered by a judicial failure in São Paulowhich went so far as to cancel the warrants in Brazil and remove the names of the suspects from the Interpol red spread.

Faced with the risk of escape financed by the high value that the group still holds, the Federal Police and the Public Ministry seek to speed up the extradition procedures.
