Moraes and Dino reject Roberto Jefferson’s appeal against fine

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), voted this Friday (5) to reject former deputy Roberto Jefferson’s appeal against payment of a fine of R$452,000.

Then, Flávio Dino followed the rapporteur and voted against the appeal. The virtual plenary trial runs until June 15th. The votes of eight ministers are still missing.

In 2024, Jefferson was ordered by the STF to pay the fine in the process that also determined a sentence of nine years, one month and five days in prison.

The former parliamentarian was accused of the crimes of slander, homophobia, incitement to crime and attempt to prevent the free exercise of powers.

According to the Attorney General’s Office (PGR), Roberto Jefferson encouraged the population to invade the Senate and carry out physical attacks against senators from the Parliamentary Commission of Inquiry (CPI) on the Pandemic. Furthermore, he incited the explosion of the Superior Electoral Court (TSE) building.

The statements were made in interviews and videos published on social media in 2021.

Fine in installments

After the conviction, Moraes granted the fine in 24 monthly installments of R$18,800.

However, the defense appealed again and alleged irregularities in the application of the fine, stating that the amount was excessive and that it compromised the former parliamentarian’s assets.

When voting in the trial, Moraes, who is the case’s rapporteur, understood that the application of the fine must be maintained.

“In conclusion, there is no repair to be made in the understanding applied, as the regulatory appeal did not present any argument capable of deconstituting the grounds mentioned”, Moraes voted.
