According to the court decision, the measure was adopted to avoid a possible evasion strategy and ensure the success of the police investigation, which is being conducted under secrecy. The judge highlighted the need to individualize conduct – that is, to prove the participation of each person being investigated – in addition to personal recognition by the victims.
According to the reasons for the decision, one of the women was in a vulnerable condition, under the influence of alcohol, when she was abused. The other reported having been raped successively by several men. For the judge, the defense’s thesis that the relationships were consensual conflicts with the reports of emotional shock and injuries presented by the victims. The crime investigated is classified as heinous.
The defense informed that it will file an appeal to try to revoke the arrests, in order to allow the athletes to be released.
