Police do not indict Bolsonaro and hold military responsible for seized weapon

The Civil Police of the Federal District did not indict former president Jair Bolsonaro in the case involving . Report forwarded to the Federal Supreme Court, to which the Young Pan⁠ had access, the indictment points out only to Army Sergeant Estácio Leite da Silva Filho.

According to the investigation, Estácio was charged with illegal possession of a restricted firearm. The PCDF concluded that, although the soldier had functional possession linked to presidential security, he was transporting a weapon registered in Bolsonaro’s name without formal authorization and in disagreement with the requirements set out in the Disarmament Statute.

In the report, the corporation maintains that the functional possession does not authorize public agents to carry a weapon registered in the name of third parties outside of legal hypotheses, understanding already supported by jurisprudence.

In a statement given on June 23rd, Bolsonaro stated that the weapon remained at his residence after a search and seizure operation by the Federal Police. According to the former president, during the action he requested that the weapons remain in his possession as he claimed the need to protect his residence, as he lived with women.

Bolsonaro also declared that, on June 15, noticed a mechanical failure in the weapon and called Estácio to check the problem. According to his version, the soldier removed the weapons from the residence without his authorization. The former president also stated that he only became aware of the case after being informed of the seizure of the weapon.
